Hern\u00e1ndez<\/a><\/span><\/div>\n<\/div>\n<\/div>\n<\/div>\n<h2 class=\"author-sig-line-wrapper\"><span class=\"author-timestamp\" style=\"font-size: 14px;\">August 14<\/span><\/h2>\n<h2 data-elm-loc=\"1\"><span style=\"font-size: 14px;\">Michelle Nicoll Gutierrez has traveled frequently from her home in Mexico to visit her aging mother and stepfather in Maryland, never overstaying her tourist visa and always returning home to her husband and their travel agency and rental-property business.<\/span><\/h2>\n<h2 data-elm-loc=\"2\"><span style=\"font-size: 14px;\">But U.S. Customs and Border Protection agents denied her entry earlier this month at George Bush Intercontinental Airport, revoking her visa and barring her from the United States for five years.<\/span><\/h2>\n<h2 data-elm-loc=\"3\"><span style=\"font-size: 14px;\">In a statement, agents said they determined Nicoll Gutierrez, who was traveling with her U.S.-born toddler, was an \u201cintending immigrant\u201d \u2014 a term used to describe visitors likely to overstay their visas and try to remain in the United States illegally. They also cited her use of legally available government health benefits in 2016, when she visited Maryland while pregnant and experienced complications, as one reason for her exclusion.<\/span><\/h2>\n<h2 data-elm-loc=\"4\"><span style=\"font-size: 14px;\">\u201cI\u2019m not the kind of person to steal or take advantage,\u201d Nicoll Gutierrez, 42, said in a phone interview from Michoac\u00e1n, Mexico. \u201cI\u2019ve always been law-abiding, and it was never my intent to stay. I don\u2019t want to be labeled a violator.\u201d<\/span><\/h2>\n<h2 data-elm-loc=\"5\"><span style=\"font-size: 14px;\">It is not uncommon for foreign visitors to be turned away by border officials if those officers believe they plan to stay. But tougher enforcement and proposals for broader and more restrictive measures for legal immigration are heightening the barriers for noncitizens, immigration lawyers say, particularly those from specific countries and including those who have followed all the rules.<\/span><\/h2>\n<h2 data-elm-loc=\"6\"><span style=\"font-size: 14px;\">Separate from the \u201cintending immigrant\u201d issue, Nicoll Gutierrez\u2019s case appears to reflect a\u00a0<a href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/trump-proposal-would-penalize-immigrants-who-use-tax-credits-and-other-benefits\/2018\/03\/28\/4c6392e0-2924-11e8-bc72-077aa4dab9ef_story.html?utm_term=.144502e02f7c\" target=\"_blank\" rel=\"noopener\">Trump administration proposal\u00a0<\/a>to disqualify people seeking legal residency or a temporary visa if they or any member of their household, including U.S.-born children, have received Medicaid or other noncash public benefits.<\/span><\/h2>\n<h2 data-elm-loc=\"7\"><span style=\"font-size: 14px;\">Nicoll Gutierrez, whose\u00a0<a href=\"https:\/\/www.houstonchronicle.com\/news\/houston-texas\/houston\/article\/Mexican-tourist-denied-entry-at-Bush-after-13139345.php\" target=\"_blank\" rel=\"noopener\">story was first reported\u00a0<\/a>in The Houston Chronicle last week, \u201cwas found to have used government assistance during a previous stay to pay for the expenses associated with having a child in the U.S.,\u201d Customs and Border Patrol said in a statement. \u201cShe was found to be an intended immigrant and returned to Mexico on the next available flight.\u201d<\/span><\/h2>\n<h2 class=\"interstitial-link \" data-elm-loc=\"8\"><span style=\"font-size: 14px;\"><i>[<a href=\"https:\/\/www.washingtonpost.com\/world\/the_americas\/international-outrage-grows-over-separating-migrant-children-from-parents\/2018\/06\/19\/13d0332e-73cb-11e8-bda1-18e53a448a14_story.html?utm_term=.af10a7aac99f\">Girl with Down syndrome taken from mother at U.S.-Mexico border<\/a>]<\/i><\/span><\/h2>\n<h2 data-elm-loc=\"9\"><span style=\"font-size: 14px;\"><b><\/b>The American Immigration Lawyers Association says it has seen a spike since April in visaapplication denials citing public-charge grounds at the U.S. Consulate in Juarez, Mexico. That follows a change early this year in the State Department foreign affairs manual, instructing consular officers to consider a wide range of personal attributes and use of public benefits when deciding whether to issue visas.<\/span><\/h2>\n<h2 data-elm-loc=\"10\"><span style=\"font-size: 14px;\">\u201cIt\u2019s a big deal. What\u2019s being proposed basically turns things on its head regarding what constitutes being inadmissible,\u201d said Kathleen Walker, an immigration lawyer in El Paso \u201cDo we want to send a message discouraging families from seeking medical attention, from feeding their children or seeking immunizations because it might affect legal status? Is that how low we\u2019ve gone?\u201d<\/span><\/h2>\n<h2 data-elm-loc=\"11\"><span style=\"font-size: 14px;\">Nicoll Gutierrez obtained a 10-year tourist visa in 2010 and used it multiple times to visit her family in Derwood, Md., just north of Rockville.<\/span><\/h2>\n<h2 data-elm-loc=\"12\"><span style=\"font-size: 14px;\">Her mother, Laura Atchley, became an American citizen after marrying John Atchley, a retired Foreign Service officer, in 2008.<\/span><\/h2>\n<h2 data-elm-loc=\"13\"><span style=\"font-size: 14px;\">The couple thought about sponsoring Nicoll Gutierrez for legal residency a few years ago but decided against it when lawyers told them the wait time for processing applications for Mexican nationals is more than 20 years.<\/span><\/h2>\n<h2 data-elm-loc=\"14\"><span style=\"font-size: 14px;\">\u201cWe\u2019ll be dead by then,\u201d John Atchley said.<\/span><\/h2>\n<h2 data-elm-loc=\"15\"><span style=\"font-size: 14px;\">Nicoll Gutierrez was about five months pregnant when she visited in fall 2016. She planned to return home within a month.<\/span><\/h2>\n<h2 data-elm-loc=\"16\"><span style=\"font-size: 14px;\">But she became ill and was diagnosed with pre-gestational diabetes, requiring expensive treatment. Doctors said she should not travel.<\/span><\/h2>\n<h2 data-elm-loc=\"17\"><span style=\"font-size: 14px;\">Nicoll Gutierrez and her mother say they were planning to use savings to pay out-of-pocket for the medical care. But an immigrant group directed them to Maryland Health Connection, the state\u2019s health insurance marketplace, where they learned from a navigator that with her valid tourist visa, Nicoll Gutierrez was eligible for Medicaid and CHIP, the Children\u2019s Health Insurance Program.<\/span><\/h2>\n<h2 data-elm-loc=\"18\"><span style=\"font-size: 14px;\">Her son was born in D.C. that December, making him an American citizen. But they confirmed Nicoll Gutierrez\u2019s visa category would qualify her for coverage in accordance with the eligibility standards set by Medicaid regulation and the Affordable Care Act.<\/span><\/h2>\n<h2 data-elm-loc=\"21\"><span style=\"font-size: 14px;\">When Nicoll Gutierrez tried to reenter the United States with her son on Aug. 4, agents peppered her with questions about her income, husband and record.<\/span><\/h2>\n<h2 data-elm-loc=\"22\"><span style=\"font-size: 14px;\">Transcripts of the interrogation, provided to The Washington Post by John Atchley, showed agents focused heavily on the details of the 2016 visit and her use of government health insurance. Agents then revoked her visa.<\/span><\/h2>\n<h2 data-elm-loc=\"23\"><span style=\"font-size: 14px;\">\u201cI was shocked,\u201d Nicoll Gutierrez said. \u201cI\u2019ve made multiple trips, and it was never my intention to stay. My life is in Mexico, but my family is in Maryland. I don\u2019t understand why this happened.\u201d<\/span><\/h2>\n<h2 data-elm-loc=\"24\"><span style=\"font-size: 14px;\"><b><\/b>Her mother, who had traveled with them from Mexico, waited for hours while Nicoll Gutierrez was questioned, missing the flight that was supposed to take them all to Reagan National Airport. After receiving a text message from her daughter, she found a CBP supervisor\u2019s office inside the airport where she could\u00a0<a href=\"https:\/\/www.washingtonpost.com\/local\/social-issues\/a-mexican-business-executive-went-to-visit-her-parents-in-md-border-agents-confiscated-her-visa\/2018\/08\/14\/321c4136-9cc7-11e8-843b-36e177f3081c_story.html?noredirect=on&amp;utm_term=.6ee5014e8d40\" target=\"_blank\" rel=\"noopener\">learn what was happening<\/a>.<\/span><\/h2>\n<h2 data-elm-loc=\"25\"><span style=\"font-size: 14px;\">The next morning, the two women embraced at the airport before boarding separate flights to their respective homes.<\/span><\/h2>\n<h2 data-elm-loc=\"26\"><span style=\"font-size: 14px;\">\u201cThey tear your life into pieces, and your freedom to visit your family, all based on a belief. An incorrect belief,\u201d Laura Atchley said. She noted that a lot can happen in five years, the amount of time Nicoll Guiterrez is prohibited from visiting.
